When the customer start his subscription and validate a purchase from KDJ Luxe on the website , he is checking the box « I agree to the terms and condition of sale».The costumer is acknowledging the read and the agreement of the terms and condition of sale without restrictions. In the terms and condition of sale, the words or expressions start with an capital letter have following meaning :-Costumer: any physical person , that subscribe to the website, to have access to informations about the items, buying items, and benefiting different other services offered by KDJ Luxe, on their account.

-Account : space on the website only available for the Costumer holder of the account , only accessible with  the login name and a password.

-Login identifier :e-mail address enable the Costumer to have access to his online account in addition to his password.-Service(s) : all types of services offered on the web site KDJ LUXE to the Costumer ,including  buying on line items and having access to additional informations about the products , the shipping, and the purchase history.

-Showroom : the local of KDJ LUXE  is localized at 102 Avenue des Champs Elysées - 75008 Paris.

Third Article- SUBJECT/MATTER

The terms and condition of sale and modalities of services, specifically those, for the Costumers, realizing on line purchases, on the Website and having access to informations about his order or his history purchase.

Fourth Article- CONTRACTUAL DOCUMENTS

It remains notice, that between KDJ LUXE and the Costumer, the terms and condition of sale added to the privacy policy and to the terms and condition of use, regulate all of their contractual relationships and apply to the exclusion of any other agreement.KDJ LUXE advices to any  one visiting the website to download or print the Terms and Condition of Sale, however without editing.KDJ LUXE reserve the right to edit anytime the Terms and Condition of Sale by publishing the latest version on the Website.

In that case, any order in course of execution will remain under the previous Terms and Condition of Sale.The modification will be affected once on the website all  Costumers after their acception.In case of acception, any new order, more broadly, the contractual relationship between the Costumer and KDJ LUXEwill be submitted to the new Terms and Condition of Sale.Any Costumer that doesn't accept  the Terms and Condition of Sale will no longer be able to continue to access the Site and the contract will be terminated by application of article "CANCELLATION".KDJ LUXE reserve the right to edit, anytime, some of the functionality of the website or adding new ones automatically submitted to the Terms and Condition of Sale.

Fifth Article- ACCESS TO THE SERVICES

The following services are  :-The creation and the management of an account, individual is removable anytime by the Costumer-The  access to the account enable the Client to use the functionality of the website, and the possibility to realize to consult information about the previous or latest purchase.The costumer service are reserved to the Costumers.

Sixth Article- THE CREATION OF AN ACCOUNT BY THE COSTUMERS

All the clients wishing to benefit from the costumer service ,have to previously subscribe to the website following the instructions.It is forbidden for a costumer to subscribe under multiple identity or under false identity.

KDJ LUXE reserve the right to remove the access to the website spaces reserved to the subscribers, therefore, access to the Services resulting from a Customer whose Identifier would be contrary to good morals or would be unlawful, without notice or compensation in favor of the Customer, or prejudice to the rights of KDJ LUXE. It will be the same in case of sending to KDJ LUXE any message with similar characteristics.The processus of subscription can not be achieved if one of the obligations is not respected or if the box « I agree to the terms and condition of sale» is not checked.

KDJ LUXE  reserve the right to the required to the Costumers to justify the giving informations.Those have to be complete et exact at the moment of the subscription on the website.In case of modification of those informations, the Costumer is committed rectify , a soon as possible in his Costumer space.

KDJ LUXE can't verify the identity of the Costumers  or truthfulness of the informations giving by the Costumers.Therefore, the Costumer recognize that any false informations, giving by himself, is likely to commit his responsibility towards KDJ LUXE.The Costumer get to choose his own login informations.It is recommended to the Costumer to change with frequency his login informations. It is highly recommended to not choose a password using random words, but to alternate between numbers and letters, capital letters and small letters.

The Costumer is the only one responsable for his login informations and use of it. He commit to keep his login informations confidential and to not communicate them. Therefore the Costumer recognize that the seizure of his login informations attest his consent for the further operations on the website.The Costumer must ensure to maintain its valid email address during the period of its registration on the Site at the risk of no longer being able to access it, especially in case of loss of its password.A Customer’s account is strictly personal and therefore cannot be transmitted, by any means whatsoever, to a third party, even free of charge.

KDJ LUXE cannot be held responsible for any damage that Customers may suffer as a result of a third-party use of their Username and Password. In the event of loss, misappropriation or fraudulent use of all or part of its username and password, the Customer shall immediately notify KDJ LUXE. It shall remain responsible for any use made of its Username and Password until it has informed KDJ LUXE and the latter has been able, within a reasonable time, to modify them. In the event that a Customer broadcasts or uses its Identifier in a manner contrary to its destination, KDJ LUXE reserves the right to terminate the contract and to delete access to the Account and the content accessible from it, without notice or compensation. KDJ LUXE may also take legal action in order to obtain compensation for any possible harm it may suffer as a result of this distribution or use.

These stipulations are expressly considered to be substantial between the parties.

Seventh Article -  DESCRIPTION OF THE SERVICES

The Costumer, like the other users, can consult items presented by KDJ LUXE on the website.Furthermore, the Costumer

can  :-Purchase one or multiple items ,

-Have Access to the delivery informations,

-Have access to his invoices

.For the purchase of items the Costumer should :-Follow the instructions on the website, especially the instructions required to the login, and eventually the registration.

-Select the or the items  of his choice, specifying that items selected by the Costumer might not be anymore available depending on the time taken to validate the order.The Costumer would have to reselect his all his items.

-Verify the order informations, and if needed edit the items selections or/and, rectify the delivery or/and the invoice informations-Validate the purchase,

-Choose a payment method,-Follow the instructions of the payment service on line and  proceed to the secured payment of the amount of the purchase

.In the event that the total price of the order exceeds the sum of one thousand five hundred (1000,) euros, including all taxes, the validation of the order will be subject, without prejudice to the following paragraph, to hardware checks by KDJ LUXE with the Customer. Failing this, the order cannot be validated.Once the payment authorization has been validated, the Customer receives a confirmation of acceptance of payment and a confirmation of the order.

Eighth Article- FEATURES OF ARTICLES ON SALE

The articles (items) on sale on the website, are second hand so the available stock can be limited to some few articles or a single one.Thus, it is possible that an items is offered for sale both on the website and in the showroom.The availability of an item is depending on the time required to update the Site. The Site is updated approximately every 2 hours.

Therefore, the Costumer will be immediately noticed by KDJ Luxe, by e-mail, about the unavailability  of the selected item during the purchase.Each item available on sale has a card describing all its characteristics such as the brand, the material, the size, the color and its condition.In this respect, the condition of the article for sale is defined according to the following categories:

- “New Condition”: the article looks new and has no defects

- “Excellent Condition”: the article has been used very little and remains without defects,

- “Very good condition”: the item has been used little and still looks very good. It may have some apparent defects,

- “Good condition”: the article shows signs of wear,

- “Correct state” means the article has marked traces of wear.

If applicable, the Customer may contact the sales department at the contact details provided in the "Sales Service" Article.

Ninth Article- PRICE OF ARTICLES ON SALE

The price of the articles is indicated on the website, in euros, all taxes included and excluding delivery costs. Furthermore, the prices are, if applicable, exclusive of customs fees and all applicable taxes that will be the sole responsibility of the Customer.At the time of order validation, the price payable includes all taxes.The period of validity of the offers of articles for sale is determined by the updating of the Site.

Tenth Article-CONDITIONS OF PAYMENT

The payment of the price by the Costumer is made by one of the following means of payment :- By credit card  (Blue card, VISA, VISA Electron, Eurocard/Mastercard, Maestro),

- By PayPal.In case of payment by credit card, the transaction is affected immediately after the verification of the credit card informations of the Costumer, upon receipt of the debit authorisation from the bank institution issuing the said bank card.

According to the article L.132-2 of the French Monetary and Financial Code, the commitment to pay by means of a payment card is irrevocable. By communicating the information relating to his bank card, the Customer authorises KDJ LUXE to charge his bank card the amount corresponding to the price.To this end, the Customer must confirm, during the settlement process, that he is the holder of the bank card to be debited and that the name on it is indeed his.In case the price throughput would be impossible, the online sale would be immediately resolved as of right.

Eleventh Article- DELIVERY OF THE ITEMS ON SALE

11.01 DELIVERY METHODS AND AMOUNT

Worldwide delivery with DHLThe Customer is informed that delivery costs are at his expense (excluding exceptional promotional operations).In this regard, when ordering, the Customer chooses one of the delivery methods offered on the Site.

The available delivery methods are:

- By courier only for deliveries in intramural Paris,

- DHL Express,

- At the showroom with the "Click and Collect" service.The amount of the delivery charges, any customs charges and any other potential taxes depends on the delivery method chosen by the Customer and the country of destination.The delivery costs are:

- 20 euros incl. tax for courier shipments in Paris,

- 30 euros incl. tax for shipments to mainland France outside Corsica (45€),

- 50 euros including taxes for shipments within the European Union,

- On quotation for the rest of the world

.- No delivery charges are applied to the Click and Collect service in the showroom.

11.02 DELIVERY TIME

The delivery times are as follows:- Eight (8) working days from the validation of the order, for delivery in mainland France (excluding Corsica),

- Fourteen (14) working days from the validation of the order, for delivery abroad or in France of Overseas and Corsica.For the "Click and Collect" service, ordered items are available in the Showroom within forty-eight (48) hours of the order validation. They may be withdrawn by the Customer, after agreeing on an appointment, upon presentation of the confirmation e-mail and a piece of identification. The appointment must be booked online at https://www.kdjluxe.com/en/module/appndigital_calendrier/formularDelivery times are in working days and correspond to the average preparation and delivery times.The Customer will receive an email informing him of the shipment of his order.In case of delivery delay, the order is not cancelled. KDJ LUXE will inform the Customer by e-mail.The Customer can monitor the progress of the processing of his order on his Account.

11.03 CHECKING THE ORDER UPON RECEIPT

The Customer is required to check the condition of the packaging as well as the items purchased upon receipt.It is up to the Customer to express any reservations and complaints it deems necessary, or even to refuse the package, when it is clearly damaged on delivery. Such reservations and complaints must be addressed to the carrier by registered letter with acknowledgement of receipt within three (3) business days of delivery.The Customer must send KDJ LUXE a copy of the letter addressed to the carrier.

Twelfth Article- RIGHT OF RETRACTION

The Costumer have a right of retraction that he can practice within fourth-teen (14) days following the date of receipt or withdrawal of the order.If the period expiries a Saturday, a Sunday or a holiday , this right is expanded until the following business day.

The Costumer that want to practice his right of retraction have to return the items within limited time previously mentioned, at the showroom address (102 avenue des Champs Elysées– 75008 Paris).

The Costumer will have to return the items in their packaging, with all of the accessories , notices or other documents originally sent.

The Costumer will have to inform our service KDJ LUXE too, of the practice of his right at the following e-mail address : contact@kdjluxe.com .

Any purchase made at the showroom will not be refund, only a voucher or exchange will be possible.

Thirteenth Article-GUARANTEE

KD JLUXE is submit to the conditions of legal guarantee provided for in Articles L.217-7 of the French Consumer (non-compliance) Code 641 and of the French Civil Code (hidden defects).

Fourteenth Article- SALES DEPARTMENT

In the year following the request to the customer service, the Customer may have his request examined by a mediator. According to article L.612-1 of the French Consumer Code, the Costumer has the right to free recourse to a consumer mediator for the amicable resolution of the dispute. To this end, the professional guarantees to the consumer the effective use of a consumer mediation mechanism. To do so, the professional must provide the contact details of the mediator to whom he reports (ART. L.616-1 FRENCH CONSUMER CODE).

Fifteenth Article-RESILIATION

15.01 RESILIATION

The Terms and Condition constitute a contract concluded between KDJ LUXE and the Customer effective on the Customer’s registration date.

As this contract is for an indefinite period, each of the parties may therefore terminate it and, therefore, terminate the Costumer's registration on the website, without cause or compensation for the other party, within fifteen (15) days notice when the termination is at the initiative of KDJ LUXE and immediately when the termination is at the initiative of the Customer. In the latter case, the Costumer simply clicks on the "Delete my account" link and confirms the transaction.

However, as long as a sale is in progress, the Terms and Conditions will remain in force; the Customer may no longer purchase a product.

15.02 TERMINATION FOR NO USE OF THE ACCOUNT

In particular, KDJ LUXE may terminate the registration of a Customer on the Site in the event that the Customer does not connect to its Account for a period of more than two (2) years. However, the former Customer may re-register.

15.03 TERMINATION FOR FAULT

In the event of non-performance by one of the parties of one of its substantial obligations, the other party may notify it of the termination of this contract fifteen (15) days after a formal notice to remedy it, Without prejudice to any damages that may be due.

KDJ LUXE may also, at its discretion, send a notification reminding the Customer of its obligations.

It is specified that KDJ LUXE reserves the right to terminate any contract binding it to a Customer who has provided it with false information during its registration on the Site or who does not respect its contractual obligations or the laws and regulations in force. In the event of an emergency, the termination of the Terms and Condition may be effective immediately, that is, without any notice or compensation to the Customer.

15.04 NOTIFICATION OF TERMINATION

In the case of a termination occurring on the initiative of the Costumer, the latter must click on the "Delete my Account" link and then confirm its willingness to delete.

In the event of a termination or suspension of access rights to the areas of the Site reserved for the presentation of the Customer’s Identifier intervening on the initiative of KDJ LUXE, the Customer shall be notified by e-mail of the alleged contractual breaches and of the possible termination of the Terms and Conditions of Business.

15.05 CONSEQUENCES OF RESILIATION

Access to the Customer’s Account is then deleted by KDJ LUXE as soon as possible.

Sixteenth Article-LIABILITY

KDJ LUXE is only responsible for the content of the pages it publishes and the Services it offers.

KDJ LUXE cannot be held liable under any circumstances for any damage that may occur on the computer system of a User or a Customer and/or for the loss of data resulting from the use of the website by a User or a Customer.

KDJ LUXE shall not be held liable for any fact other than those relating to the publishing of the Site and the messages exchanged in connection with the Services. KDJ LUXE does not guarantee the availability or performance of the Site. KDJ LUXE’s liability can only be sought for direct and foreseeable damages, caused exclusively by a breach of KDJ LUXE’s obligations.

In the event that KDJ LUXE’s liability is sought due to a breach by a Customer of its obligations under the contract binding it to KDJ LUXE or the laws in force, The Customer guarantees KDJ LUXE against any convictions against KDJ LUXE or amicable compensation. This guarantee covers both the compensation that could be paid, as well as the legal fees and legal costs that would be borne by KDJ LUXE.

Seventeenth Article- MAJOR FORCE

KDJ LUXE shall not be held liable for any default, delay or non-performance of its obligations under the Terms and Condition, where such default, delay or non-performance is related to a case of major force.

Expressly, are considered as cases of major force or fortuitous cases, in addition to those usually retained by French jurisprudence: total or partial strikes, internal or external to KDJ LUXE, lockout, bad weather, communication blockages for any reason, computer or server failures, electrical or technical problems blocking telecommunications, failure or malfunction of transmission networks via the internet and any other case beyond the control of the parties, preventing the normal execution of the Terms and Condition.

In addition, the Costumer states that it is aware of the complexity of the global networks, the unequal capacities of the various subnetworks, the influx at certain times of users and the various “bottlenecks” in certain places of the Internet. The current protocols for transmission via the Internet do not allow to ensure in a certain and continuous way the good reception of the messages and the integrity of the documents transmitted, KDJ LUXE shall not be held liable in the event of bad transmission due to a failure or malfunction of these transmission networks.

Eighteenth ARTICLE-LANGUAGE OF THE CONTRACT

The French version of the Terms and Condition is the only legally valid and can only be produced in court.

Nineteenth Article- APPLICABLE LAW AND JURIDICTION

These Terms and Condition are applicable under the french law.
